On January 5, 2010 Scientology chief lawyer Kendrick L. Moxon filed a new personal
law suit against me. It was like manna from heaven and so I have kept that information
quiet until now. I wanted to jam Moxon into the court room with a cross-complaint
that would prevent him from getting off the hook by dropping his law suit and
fleeing on the Freewinds when the going gets rough. Judge Alexander H. Williams,
III has retired from the Los Angeles Superior Court bench and is now a private
judge with his own website (Judge Alexander H. Williams III (retired) - Dispute
Resolution).
In my opinion Rick Moxon has fired a major foot bullet.
The law permits me to show how Moxon engaged in crime, fraud and abuse to obtain
the orders against me in the Berry and Pattinson cases. If I prevail the ramifications
could be very significant. As you will read in my papers, there is overwhelming
evidence in support of my claims. The new law suit was filed against me on the
eve of the
AGP pansy patch prosecution.
I have little doubt it was filed to serve on me, and presumably distress me,
as I commenced the AGP defense. You can read the parallel use of the Hurtado
service during the Pattinson hearing (Berry Answer & Cross-complaint paragraph
46). However, on the morning of trial AGP plead out to a deal that resulted
in a mere $165.00 penalty (the court refunded him a bunch of money!!!).
The Moxon law suit is not verified so I did not have to respond under penalty
of perjury. In this particular type of law suit I cannot get damages, only a
judges ruling as to whether Moxon obtained his various orders through a fraud
by an officer of the court. The case law provides that fabrication of evidence,
misrepresentation, and perjury by an attorney (whether for himself or a client)
would constitute a fraud upon the court. The Berry law suit is verified so Moxon
has to respond to me under penalty of perjury. My answer and cross-complaint
was served on the Moxon false front office late Friday afternoon February 12,
2010. And what did the receptionist at the official Moxon & Kobrin law office
address say? “Mr. Moxon doesn’t have his office here but we do get mail for
him. I’ve spoken to him several times.” Moxon’s real office is within the Church
of Scientology International Office of Special Affairs. However, my cross-complaint
only names Kendrick Moxon as a defendant. As far as I can see he is on his own
in this one.
